Welcome to Herzog Lawn Care & Landscaping! By accessing or using our services, you agree to be bound by the following terms and conditions. Please read them carefully.

 

1. Scope of Services

Our company provides landscape installation, maintenance, and mulch/rock installation services within Hendricks County, Indiana. The specific services will be detailed in a written estimate or agreement provided to you before work begins.

 

2. Estimates and Payments

  • Estimates: All estimates are valid for 30 days unless otherwise stated. Prices may vary based on material costs, labor, or unforeseen project conditions.
  • Deposits: A deposit of 50% is required before scheduling services. Deposits are non-refundable except as outlined in Section 6 (Cancellations).
  • Payment Terms: Full payment is due upon project completion unless specified in your agreement. We accept cash, checks, and credit cards as valid forms of payment.
  • Late Payments: Payments not received within 10 days of the due date may incur a 3% late fee.
 

3. Scheduling and Project Timelines

  • Scheduling: Service dates are subject to availability. We strive to accommodate your preferred timeline but cannot guarantee specific dates.
  • Weather Delays: Inclement weather may result in rescheduling. We will notify you as soon as possible in the event of a delay.
 

4. Client Responsibilities

  • Access: You must provide clear access to the worksite, including unlocking gates and removing obstacles.
  • Pets and Children: Please ensure pets and children are kept away from the work area for their safety.
 

5. Warranties and Guarantees

  • Plant Materials: We do not offer a plant warranty.
  • Workmanship: We guarantee workmanship for one year following project completion. Issues arising from misuse or lack of maintenance are excluded from this warranty.
 

6. Cancellations and Refunds

  • Cancellations: You may cancel your service agreement up to 48 hours before the scheduled start date. No refunds will be provided if materials have already been purchased for your project.
  • Refunds: If materials have already been purchased, refunds for unused services or materials will not be provided. Refunds for other circumstances will be processed within 14 days of cancellation approval.
 

7. Limitations of Liability

We are not responsible for:

  • Damage caused by weather, natural disasters, or acts of God.
  • Pre-existing conditions on your property.
  • Repairs or corrections required due to third-party interference.

Our total liability is limited to the amount paid for the specific service or project.

 

8. Changes to Services

Any changes to the agreed-upon scope of work must be documented in writing and may result in additional charges or adjustments to the timeline.

 

9. Termination

We reserve the right to terminate services if:

  • Payment terms are not met.
  • Worksite conditions are unsafe.
  • There is a breach of these terms and conditions.

10. Governing Law

These terms are governed by the laws of the State of Indiana. Any disputes arising from these terms or our services will be resolved in the courts located in Hendricks County.
